Chapter 1 General principle

The first Background
In order to promote the development of China's Internet standards, universal Internet applications, in the “exchange commutation and pragmatic cooperation”, the Chinese Electronics Standardization Institute will build up the Internet Standards Open laboratory (following referred to as "laboratory"), all kinds of companies of the Internet fields and carry out the development of the internet standard and the promotion work. In order to ensure the orderly conduct of the laboratory work and unification of the partners of the cooperation units, develop the statute on purpose.

The second Name
 The full name of the laboratory is “Internet Standard Open Laboratory”. The English full name is” Internet Standard Open Lab”; ISOL is for short.

The third Purpose
 Grasp the development of the Internet technology, promote the development of the Internet standards, and promote the application of the Internet standards and the fine development of the Internet application.

The forth Nature
 The laboratory is the open laboratory, is a non-profit laboratory which is set up by the enterprises which independently and voluntarily assist the Chinese Electronics Standardization Institute and admit the constitution of the laboratory.

The work of the laboratory is as follows: 1、the development of Internet standards；2、standards compliance-related testing and certification； 3、the international standardization; 4、 the outcome of the promotion.

The sixth   Formulation of the standards
 Research and trace the standard system of the related fields of the home and overseas, plan and organize the national standards and the industry standards.

The seventh: standards compliance-related testing and certification
Carry out the work of the Internet product of standards compliance-related testing tool development and testing certification, improve product quality, clean up the market environment.

The eighth   The international standards work
Cooperate positively with the International Standard Organization, organize the demotic experts and enterprises to participate in the international standard work, provide the channels to the internationalization of the formulation of the standard.

The ninth    The popularization of the outcome
On base of the outcome of research of the open laboratory, train and counsel to popularize the use of the Internet standards and the related research results.
The third chapter: the partners and of responsibility and obligation

The tenth    The categories of the members
 The members of the laboratory divide into profit units and non-profit units. The partners of the profit units divide into A, B, C-class. After the voluntary application and the examination of the laboratory, becoming the partner units. 

The eleventh    The A-class partners of the profit units’ rights and obligation
1、A-class cooperator can delegate an expert as a laboratory Advisory Board and actively participate in the work of laboratory organized consultants .
2、A-class cooperator can delegate an expert as the members of the laboratory related corporation field technology and actively participate in the planning of the technology and the seminar of the laboratory.
A-class cooperator can delegate related technology expert take part in the standard related research work of the laboratory relevant cooperation areas and the internal technical exchanges and have the achievement signed rights of the participated projects.
A-class cooperator can delegate an expert as a laboratory Advisory Board and actively participate in the work of laboratory organized consultants.
4、A-class partner can participate in related cooperation areas’ national standard formulation of the laboratory planning and can become the leading drafting unit of the national standard according to the circumstances.   
5、A-class partners can provide related technology of the relevant cooperation areas research, standards and the information of the case, provide relevant technology and train according to the party needs.
6、A-class partners can provide proprietary related areas of cooperation related software products for the use of laboratory research .
7、A-class partners can the laboratory research achievement of graduates of the Chinese Electronic Technology Standard , which is commonly popularized in the international and home, and assist to organize, undertake or take part in positively the related international exchange of the laboratory related cooperation areas and the conference work.

The twelfth     The rights and obligation of the B-class partners of the profit units
1、B-class partners B can delegate an expert as an member of the technology commission of the laboratory related cooperation areas and positively take part in the technology planning of the laboratory and the seminar.
2、B-class cooperator can delegate related technology expert take part in the standard related research work of the laboratory relevant cooperation areas and the internal technical exchanges ,conform to the recommendation results of the laboratory and make sure the achievement signed rights of the participated projects .
3、B-class partners can participate in formulation of related cooperation areas national standard of the laboratory planning,  conform to the recommendation results of the laboratory and determine whether they can become the part drafting units of the national standard according to the circumstances.
4、B-class partners can provide related technology of the relevant cooperation areas research, standards and the information of the case, provide relevant technology and train according to the party needs.
5、B-class partners can provide proprietary related areas of cooperation related software products for the use of laboratory research .
6、B-class partners can assist the laboratory research achievement of graduates of the Chinese Electronic Technology Standard , which is commonly popularized in the international and home, take part in positively the related international exchange of the laboratory related cooperation areas and the conference work.

The thirteenth   The rights and obligations of C-class partners of the profit units
1、C-class partners can apply to become the technical committee members units of the laboratory related cooperation areas and comply with the assessment results of the Party. If they become the member units, need to delegate an expert to participate actively in the laboratory of the technology planning and seminars.
2、C-class cooperator can delegate related technology expert take part in the standard related research work of the laboratory relevant cooperation areas and the internal technical exchanges ,conform to the recommendation results of the laboratory and confirm the achievement signed rights of the participated projects .
3、C-class cooperator can delegate related technology expert take part in the standard related research work of the laboratory relevant cooperation areas and the internal technical exchanges ,conform to the recommendation results of the laboratory and confirm the achievements signed rights of the participated projects .
4、C-class partners can participate in the national standards formulation of the laboratory planning related cooperation areas,   comply with the recommendation results of the laboratory and determine whether they can have the qualification of the drafting of the national standards.
4、C-class partners can provide related technology of the relevant cooperation areas research, standards and the information of the case, provide relevant technology and train according to the party needs.
5、C-class partners can provide proprietary related areas of cooperation related software products for the use of laboratory research .
6、C-class partners can positively participate in cooperation areas exchange of the domestic and oversea according to the planning and organization of the Chinese Electronics Technology Standard institute.

The fourteenth: the rights and obligations of the non-profit units
1、The non-profit units can agree to the Party laboratory on recommendation of he Chinese Electronics Technology Standard institute, B can delegate an expert as the members of the laboratory related corporation field technology and actively participate in the work of laboratory organized consultants.
2、The non-profit units can delegate an expert as the members of the laboratory related corporation field technology and actively participate in the planning of the technology and the seminar of the laboratory.
3、The non-profit units can delegate relevant technology experts to take part in the A standards related research work of the cooperation  areas of the laboratory and the internal exchange, have the achievements signed rights of the participated projects.
4、The non-profit units can participate in formulation of the national standard of the related cooperation areas of the laboratory and the industry standard, can become the leading drafting unit of the national standard according to the circumstances.   
5、The non-profit units can provide related technology of the relevant cooperation areas research, standards and the information of the case, provide relevant technology and train according to the party needs.
6、The non-profit units can participate in the research achievement of the laboratory, which the Chinese Electronics Technology Standard Institute commonly promote in the domestic and overseas, assist to organize, undertake or take part in positively the related international exchange of the laboratory related cooperation areas and the conference work.

Chapter 4 organizations

The fifteenth: the main organizations
1. consultant committee;
2. field Technical Committee;
3. Administration Department;
4. research and development Department;
5. Cooperation Department and Promotion Department;

The sixteenth:On the consultant committee
1. Laboratory invites the well-known experts ,scholars or officials in the industry to compose laboratory consultant committee ,as a laboratory consulting agencies;
2. The consultant committee will hold a meeting regularly to to provide advice and recommendations for the development of the Laboratory;

The seventeenth:On the field Technical Committee
1. According to the work need,Laboratory can establish the Field Technical Committee, as a technical consulting agencies of the Laboratory in the field;
2. It is composed of the technical responsible persons who recommended by Chinese Electronics Standardization Institute and partners;
3. The specific responsibility of the expert committee refers to the Statutes of the Technical Committee in the areas;

The eighteenth:on the Laboratory
1. According to the work need, Administration Department, research and development Department, Cooperation Department and Promotion Department are the main bussiness of the Laboratory’s work;
2. departments of the Laboratory work in accordance with their respective work;

Chapter 5 Fund management

 

The nineteenth: Fund Source
1. Cooperation costs paid by the partnerships;
2. the fund of the commission project of other agencies
3. the operating costs provided by Chinese Electronics Standardization Institute for the Laboratory;
4. Government stake and other committal;
5. Other lawful income;

The twentieth: Fund use
1. the development fund of Related standards and criterion;
2. the work meeting fund of the field Technical Committee;
3. the propaganda costs for Laboratory news;
4. Laboratory personnel and day-to-day office expenses;
5. International Standardization costs;
6. the expenditure of informal meeting for other marketing activities;
7. Work-related expenses of intellectual property rights;

The twenty first: The use principles
The funds must be used for the development of Laboratory business and career which the statute stated,shall not allocate them in the members of units ,and shall not impropriate and deal with as profit by the commission units.

The twenty second: Financial Management
The Laboratory’s funds are collected by Chinese Electronics Standardization Institute who will establish a strict the financial auditing system, monitor and execute the daily income and expenditure to ensure accounting information legal, true, accurate and complete;

The twenty third: Financial Supervision
The Laboratory’s management accept the financial supervision of the cooperation member units, in each quarter will be open the expenditures for cooperation unit.

The twenty forth: Special Tips
Any unit or individual shall not occupy, privately divide up and impropriate the laboratory’s funds.

Chapter 6 intellectual property rights management

 

The twenty fifth: Intellectual property rights management principles
Laboratory is obligate to protect the intellectual property rights of cooperation unit, the laboratory will organize and develop management policies  of the laboratory intellectual property rights.

The twenty sixth: the intellectual property rights of the outcome
Laboratory own the intellectual property rights of the research outcome and one contributed  to the outcome own intellectual property rights of the contributing part.
